		<title>The 26 Year Foreclosure</title>

			<content:encoded><![CDATA[<p>How would you like to live in your home for free?  Well, almost&#8230;</p>
<p>Patsy Campbell has not made a mortgage payment on her home for 26 years.  Yes, I said 26 years.</p>
<p>Almost every Real Estate Attorney agrees it is the longest foreclosure case in America&#8230;  and probably the WORLD for that matter.</p>
<p>Miss Campbell has pulled just about every legal maneuver possible to delay foreclosure of her home for over two and a half decades.</p>
<p>The home was last appraised at over $200,000.</p>
<p>The short version of the story goes something like this.</p>
<p>In 1978 her husband Paul purchased the home with a mortgage for $68,000 from First Federal Savings.</p>
<p>He married patsy in 1980, later passing on and leaving the property to her.</p>
<p>Patsy became ill in 1985 and the loss of income caused her to stop making mortgage payments.</p>
<p>At this point, the Mortgage Holder First Federal had now merged with First Fidelity Savings and Loan which took over the servicing of her mortgage.</p>
<p>Later in 1987 the mortgage was sold by First Fidelity to American Pioneer Savings.  American Pioneer Savings went broke in the early 1990&#8242;s.</p>
<p>The loan continued to change banks 6 times and each time it changed the foreclosure case was either delayed and or dropped as the financial institutions went out of business as well as fell victim to her later stall tactics.</p>
<p>Finally, her mortgage wound up with the Resolution Trust Corporation (RTC) which was the federally owned entity which was in charge liquidating assets from the Savings and Loan Crisis in the 90&#8242;s.  Eventually the FDIC was in charge of her mortgage.</p>

<p>Then, in 1998 the FDIC sold the mortgage to Commercial Services of Perry Iowa.</p>
<p>Commercial Services is a buyer and investor of distressed debt which filed for foreclosure on the Campbell home in the year 2000.</p>
<p>Obviously, after delaying foreclosure for 26 years, Miss Campbell has used a number of strategies to stay in her home.</p>
<p>In the beginning she had the help of a retired Lawyer, but today she&#8217;s learned so much about the law she&#8217;s actually handling the case herself.</p>
<p>The has appealed her case 7 times since 2000.</p>
<p>Among some of her tactics were claims that:</p>
<p>The note for her property was incorrectly assigned.</p>
<p>Lawyers waited too long to prosecute her case</p>
<p>The original sellers never received funds due from the bank.</p>
<p>Her husband&#8217;s signature was forged.</p>
<p>Her note was incorrectly separated from her mortgage agreement.</p>
<p>The loan was not properly transferred between the multiple financial institutions in went through.</p>
<p>In many cases she demanded documents the lenders were unable to generate (or generate quickly enough).</p>
<p>Once  due to illness she put the home in her daughter&#8217;s name then later had the house deeded back to her.</p>
<p>Probably the most entertaining argument is when she denied there was any legitimate debt.</p>
<p>In 2007 a judge threw out many of her arguments as an unnecessary use of judicial resources.</p>
<p>Attorney Robert Summers for Commercial Services says &#8220;It&#8217;s almost like clockwork.  You know you&#8217;re going to get a three-inch stack of documents every month or so, and you have to take the time to read through them.</p>
<p>It&#8217;s a burden on the courts, a burden on lawyers to decipher it, and it has enough meat in it that it&#8217;s not all void.&#8221;</p>
<p>After a very long fight Commercial Services finally got a date to take the foreclosure to trial.</p>
<p>In response, Miss Campbell filed Bankruptcy and In the state of Florida, bankruptcy stops foreclosure until a stay is lifted by the bankruptcy judge.</p>
<p>Miss Campbell currently maintains that no one owns her mortgage and because of all the mistakes the both private and federal institutions have made handling it, the debt is null and void.</p>
<p>It should be noted that any homeowner delaying foreclosure can raise defenses in court which may be baseless but still present legal obstacles for the banks to overcome.  These obstacles cost both time and money and lots of it.</p>
<p>Moodys predicts foreclosures will increase from about 1.8 million in 2010 to 2.1 million in 2011.</p>
<p>With that said, I am sure we can all expect to see more foreclosure cases being delayed by other Americans following Miss Campbell&#8217;s lead.</p>

		<title>Too Many Victims&#8230; Not Enough Ambulances&#8230;</title>

<p>You see, our society (as a whole) simply has;</p>
<p>&#8220;Too Many Victims and Not Enough Ambulances&#8230;&#8221;</p>
<p>In this scenario you, as a part of society, have two primary choices in most crisis situations (such as the foreclosure crisis):</p>
<p>1.) Lie in the street, bleeding and waiting for an ambulance to save you.</p>
<p>or</p>
<p>2.) Don&#8217;t even play the bleeding victim in the street in the first place.</p>
<p>Let me explain&#8230;</p>
<p>Recently I heard a guy with one of the fastest growing talk shows in America talk about how people were losing their homes due to what he referred to as &#8220;NO FAULT OF THEIR OWN&#8221; and&#8230;</p>
<p>&#8230;after they lost their homes their credit would be shot and then getting a job was difficult because employers were looking at their FICO Scores.  To the talk show host this was &#8220;Unjust&#8221; and &#8220;UnFair&#8221; and something had to be done!</p>
<p>I don&#8217;t know about you, but in my personal philosophy I have to laugh and disagree.</p>
<p>Here&#8217;s why:</p>
<p>The world in which we live has rules.  These rules (while we may not always like or agree with them) cannot be bent or broken (at least not the vast majority of them anyways).</p>
<p>These are rules like:</p>
<p>1.) You can&#8217;t make someone truly love you (though websites like this might lead you to believe otherwise <a href="http://www.doubleyourdating.com/">http://www.doubleyourdating.com/</a> or <a href="http://www.catchhimandkeephim.com/">http://www.catchhimandkeephim.com/</a>)</p>
<p>2.) You can&#8217;t change who your parents or siblings are.</p>
<p>3.) You can&#8217;t change your past experiences or what has happened to you.</p>
<p>You see, there are inherent risks in life we are FORCED to accept (whether we agree with them or not).  This is because these are universal laws .</p>
<p>For example, being born has the inherent risk you could end up with cancer or some other terminal disease (and be forced to accept it).</p>
<p>Being  in love comes with the inherent risk your lover may wake up one day and not be&#8221; in love&#8221; with you anymore and again, you&#8217;ll be forced to accept it (and websites like this one are geared for that: <a href="http://marriagemax.com/index0105c.asp">http://www.marriagemax.com/</a> )</p>
<p>Now, there are many things we do in life with extreme risk which we don&#8217;t even think about.  Like:</p>
<p>1.) Driving on two lane roads where nothing but a &#8220;four inch line of paint&#8221; is keeping the other person from going into our lane and maiming or killing us.</p>
<p>2.) Eating food from sources which could be tainted and cause us to get sick or die.</p>
<p>3.) Engaging in other high risk sports like mountain biking, motocross or even skiing which can lead to serious injuries.</p>
<p>However, when it comes to the risk of taking on debt (like a home mortgage) many people fail to take responsibility for the risk they are taking on; especially if the mortgage was an adjustable one.</p>
<p>Think about this for a moment&#8230;   I mean REALLY think about this.</p>
<p>What if everyone in the country just said &#8220;NO&#8221; to signing up for any adjustable rate mortgage?  What if everyone only bought homes with 30 year fixed mortgages?</p>
<p>What kind of shape do you think the housing market (and the Nation) would be in today?</p>
<p>After all, why would anyone buy using a an adjustable rate mortgage?  The adjustable mortgage has far more risk.  In fact, it is a clear fact that if everyone had bought their home during the housing boom with a  30 year fixed mortgage the country would not be in nearly the mess it&#8217;s in today.</p>
<p>Sure, many real estate industrialists may argue otherwise and so will many consumer advocates with nonsense like:</p>
<p>I&#8217;d didn&#8217;t realize what I was signing!</p>
<p>They rushed me through the process and misled me!</p>
<p>We all have learned lessons from listening to dumb or untrustworthy people.  Also&#8230;</p>
<p>Many of us, when young, were offered rides from parties with drunk drivers or even offered hardcore drugs AT THE PARTY but it was &#8220;common sense&#8221; and a little &#8220;caution&#8221; combined with responsibility which made us say no (that is, if you did say no).</p>
<p>And, of course, we learned lessons from those that got into those drugs.</p>
<p>So, whenever we find ourselves in a scenario that we got ourselves into, even if it involves circumstances beyond our control, we have two choices:</p>
<p>1.) Lie in the street, bleeding and wait for an ambulance to save us.</p>
<p>or</p>
<p>2.) Don&#8217;t play the bleeding victim in the street in the first place.</p>
<p>If your FICO Score is shot, then the sooner you start taking the steps to rebuild it, the sooner you will be in the position to benefit from the mistakes of yourself and others.</p>

<p>The meditations at the beginning drive me insane but once he starts talking it’s REALLY good. There are a lot of people who come off like Tony Robbins or other “rah rah” pump you up speakers but…</p>
<p>…There is almost no one who emulates (or imitates) Marc Allen.</p>
<p>Onward.</p>
<p>The title of this email/post is:</p>
<p>“The Department of Corrections and who the TSA Should Really be Scanning”</p>
<p>It all started when I was enjoying a draft beer down in Reno at the Great Basin Brewing Company (Not a big fan of Reno but the beer and food at this place is incredible!  I like the Nevada Gold).   Learn more here:</p>

<p>Anyway…</p>
<p>I end up talking to this guy who works for the Department of Corrections over in California (Interesting chap, to say the least).  So, I had to pop the question…</p>
<p>You see, being self employed in this ever changing market place I always have yearned for the security a state job could bring; not to mention the sweet Pension.  Did I mention many CA Correction Officers retire with over $80,000+ per year?</p>
<p>So, I ask him “Man, it must be a good feeling going to sleep knowing you’ve got job security and a killer pension?”</p>
<p>He responded “Yeah, it’s good, but it comes with a price tag few are willing to pay.”</p>
<p>“What’s the first example that comes to mind?” I replied.</p>
<p>(Then he told me a story I’ll never forget, nor will you after today).</p>
<p>He explained “I want you to imagine 10 convicts in a room with us.  Now, we ask em all to strip down to nothing and put their hands up against the wall.”</p>
<p>I interrupted “I DON’T like the sound of this!”</p>
<p>“Wait, I’m not done yet” he responded.  “Now, we tell them to ‘spread em” and I ain&#8217;t talking about their feet, ok?”</p>
<p>“Oh God!” I blurted out.</p>
<p>“Wait… wait…  I’m not done yet.” He says.  “Then, with plastic gloves you gotta search em, ok?  Are  you with me?” he asks.</p>
<p>“You can stop right there.  That’s enough!” I said.</p>
<p>“Wait!  I’m not done yet” he replies.</p>
<p>Then, when you’re “searching” one of them…</p>
<p>(WARNING!!!  WARNING!!!  WARNING!!! If you are easily offended do NOT keep reading…  YOU HAVE BEEN OFFICIALLY WARNED!)</p>
<p>He continued “Then, when you’re searching one of them you hit what feels like a small brick.  And now you gotta tell the inmate to let go of it.  I mean, you gotta YELL AT HIM…. LET GO OF IT!”</p>
<p>(At this point I realized I had opened up a conversation I wish I had never started but at the same time I was curious.)</p>
<p>So, I asked him the natural thing anyone in my shoes would ask “What was it?  What did he have?”</p>
<p>He took a sip of his beer and like it was nothing grinned at me and said “He was trying to get a cell phone in.”</p>
<p>“A CELL PHONE!?  A CELL PHONE!?” I shouted.</p>
<p>“You gotta be kidding me!” I replied.</p>
<p>“Do I look like I’m kidding” he responded.  Then he followed up with “I might be able to get you’re a job if you’re interested.”</p>
<p>To say the least…  people in the Department of Corrections EARN their money.  Just try their job for a day if you’re at all “Curious.”</p>
<p>But this got me thinking…  we&#8217;ve got all these scanners at the airports exposing people to radiation who aren&#8217;t even a potential threat.  Not even .01% are a threat I bet.</p>
<p>So…</p>
<p>Why the heck doesn&#8217;t the TSA Scan inmates?  I mean, doesn’t that make a whole lot more sense?</p>
<p>After all, the United Kingdom is now doing it:</p>

<p>It illustrates that fact the NO ONE IS IMMUNE to the cost of a low credit score.  The guy from the department of corrections had gone through a divorce which destroyed his credit years ago.  But that WASN&#8217;T the real problem?</p>

			<content:encoded><![CDATA[<p>No matter what credit course they buy, or even if they don&#8217;t buy one at all, many people find themselves consistently coming up short in one single area&#8230; and it happens to be one area that can have considerable negative impact on their credit.</p>
<p>One thing, that&#8217;s it. And it can be blamed for a good 75% (or more) of the FAILURE related to consumer credit repair efforts.</p>
<p>It&#8217;s the one common mistake that people make no matter what method they choose, no matter what course they buy, no matter how smart or stupid they are.</p>
<p><em>(Alright, so what is it already?)</em></p>
<p>Be patient dang it. <strong> </strong>I&#8217;m getting there.</p>
<p>I don&#8217;t know <strong>why </strong>people so <strong>consistently </strong>make this <strong><em>same </em></strong>mistake.</p>
<ul>
<li>Perhaps it&#8217;s because nobody told them that the <strong>credit bureaus </strong>and <strong>creditors </strong>don&#8217;t give a &#8220;rat&#8217;s a$$&#8221; about their credit.</li>
</ul>
<ul>
<li>Perhaps it&#8217;s because they think most people are &#8220;good people&#8221;, and that while &#8220;creditors&#8221; and &#8220;credit bureaus&#8221;  are not <em>really </em>definable as people, somehow this &#8220;good people&#8221; rule still applies to them.</li>
</ul>
<ul>
<li>Or, maybe they&#8217;re afraid.  Maybe they perceive the credit bureau as a <strong>dangerous</strong> <strong>monster </strong>(a fair description, I&#8217;d say) and they&#8217;re just scared to cross the monster&#8217;s path.</li>
</ul>
<ul>
<li>Or maybe they think they don&#8217;t deserve better credit. Maybe they think that if they reach for the cookie and their hand gets slapped, it&#8217;s a sign that wanting cookies is a bad thing and that nobody should <em>ever </em>reach for them.</li>
</ul>
<p>SO, what&#8217;s this one &#8220;uber-mistake&#8221; that so many people are making?</p>
<p>It&#8217;s simple&#8230; so simple, you might think it&#8217;s kind of dumb.  Maybe that&#8217;s why it is so often overlooked.</p>
<p><strong>Here it is:</strong></p>
<p><strong>People quit too soon.</strong></p>
<p>Yep. That&#8217;s it.</p>
<p>They lack persistence.  They quit before the game is over. <strong> When they meet resistance, they think that&#8217;s the end.  They try xyz method, and when xyz method fails, they get angry and say things like &#8220;this stuff doesn&#8217;t work!&#8221;</strong></p>
<p>Please understand something: The <strong>credit bureau systems </strong>are <strong><span style="text-decoration: underline;">DESIGNED</span></strong> to make you want to <strong>throw the credit repair book through the window</strong> and <strong>QUIT</strong>.  I mean it&#8230; they are</p>
<p><strong>** D   E   S   I   G   N   E   D ** </strong></p>
<p>that way.</p>
<p>I&#8217;d offer up proof (which there is plenty of) but that isn&#8217;t the point of this post.</p>
<p><strong>The point is, the ONLY &#8220;silver bullet&#8221; in credit repair is a consumer who refuses to give up.  Other than that, there are really no magic tricks.</strong></p>
<p>Sure, you need knowledge, you need to learn the methods, you need to have a good &#8220;bag of tricks&#8221; and sometimes even someone to help tell you how to use the bag of tricks&#8230; but in the end, the one thing that will separate the successes from the failures is PERSISTENCE.</p>
<p>So I guess what I&#8217;m trying to say is&#8230;</p>
<p><strong>Reach for the cookie.</strong> Don&#8217;t give up. Hang in there.
